ممثلة بقضاتها وعلمائها - أن تختار لنفسها ما يكون فيه صلاح أمرها وسعادتها، فالقاضي مطالب بأن يبذل قصارى جهده في فهم الدعوى المرفوعة أمامه، ثم في تصنيفها تمهيداً للحكم عليها بما هو منصوص عليه في الشرع، أو يقوم بالاجتهاد فيما لا نص فيه إن كان أهلاً للاجتهاد، ثم يختار بعد ذلك الطريقة المناسبة لتنفيذ الحكم إن لم تكن الطريقة محددة من قبل الشرع. وبما أن الشرع قد أوجب على القاضي الكثير من الأعمال، وفوضه في الكثير من الأمور بالاجتهاد لاستنباط حكم الشرع؛ فقد اشترط الشارع فيمن يتولى منصب القضاء شروطاً متعددة لضمان عدم وقوعه في الحيف والجور، ثم أعانه على عمله بأن شرع له منارات يستهدي بها خلال عمله وحكمه، ووضع له ضوابط حظر عليه تجاوزها أو تعديها أثناء استخدامه لتقديره الذهني في القضاء.\u003c\/p\u003e\n\u003cp\u003eوهذا النشاط الذهني الذي يقوم به القاضي في تحديده لنوع الدعوى واختياره للحكم المناسب لها وتنفيذه للحكم هو ما يدعى بالسلطة التقديرية للقاضي. وهي ملازمة للسلطة القضائية، إذ حيثما وجدت السلطة القضائية وجدت السلطة التقديرية؛ إذ لا يقام قضاء من دون قاض. وعلى الرغم من أهمية الدراسة حول هذه السلطة فإنني لم أقف على دراسة خاصة عنها إلا عند رجال القانون، ولم أقف على مرجع فقهي قديم أو حديث أفرد لهذا الموضوع، وإنما يقف الباحث على صفحات أو مباحث متفرقة أو مسائل يشير فيها مؤلف الكتاب إلى أن حكمها مفوض لتقدير القاضي واجتهاده حسب ما يراه من المصلحة. وأكثر ما يوقف عليه في الكتب الحديثة بعض الرسائل الجامعية التي تناولت جانباً أو أكثر من هذا الموضوع، مثل (حدود سلطة القاضي الجنائي في تفسير دليل الإدانة -رسالة ماجستير لأبي الوفاء إبراهيم)، و(سلطة القاضي الجنائي في تقدير الأدلة- رسالة دكتوراه لناصر إبراهيم محمد زكي)، و(ضوابط السلطة التقديرية في الفقه الإسلامي -رسالة ماجستير لنذير أوهاب). فمن أجل ذلك عقدت العزم على استقراء كثير من كتب القضاء لجمع ما تناثر من النصوص المتعلقة بهذا الموضوع ثم دراستها، في محاولة لاستنباط ما جعله الشارع نجوماً للقاضي يهتدي بها، ثم استنباط ضوابط استخدام القاضي لنشاطه الذهني في التقدير، ثم محاولة تطبيق ذلك على مختلف أنواع الدعاوي.\u003c\/p\u003e\n\u003cp\u003eوأمهد لهذا البحث بذكر الصفات التي اشترطها الشرع الحنيف فيمن يتولى هذا المنصب الخطير، ثم أذكر أثر كل صفة من هذه الصفات في السلطة التقديرية للقاضي، وأهمية اشتراط الشرع لها. على أن طريقتي في هذا البحث تتلخص فيما يأتي: استخرجت النصوص الفقهية المتعلقة بالرسالة من كتب كل مذهب على حدة، ولا آخذ المذهب من غير كتبه إلا عند الضرورة مع الإشارة لذلك إن فعلت. حاولت جاهداً استقراء كثير من المراجع القديمة والحديثة؛ لإثراء البحث من جهة، ولإرشاد من أراد التوسع إلى أسماء كثير من المراجع من جهة أخرى، مع استعانتي بعبارات بعض الكتب للوصول إلى المراد بشكل أدق . حاولت تقصي كل ما في المذهب الواحد من أقوال -وإن كانت غير معتمدة-؛ لبيان ثراء الفقه الإسلامي وخصوبته، ولإطْلاعِ القاضي على بعض الأقوال التي قد يضطر للأخذ بها في بعض الحالات المستثناة، وأبين- في الغالب- المعتمد والراجح في كل مذهب، مع محاولة الاختصار في البيان ما أمكن. نتج عن استقراء بعض المراجع العثور على مسائل متفرقة تتعلق بالبحث، حاولت أن أنظمها ضمن مسائل عامة، وجعلت لها عناوين بارزة، ورتبتها حسب ما رأيته مناسباً.\u003c\/p\u003e\n\u003cp\u003eلا تخفى صعوبة الكتابة في مثل هذا البحث في بعض جوانبه، لذلك اضطررت في مسائل إلى أن أنسجها من أكثر من مذهب؛ لتعذر حصولي على حكمها في بعض المذاهب؛ والمذاهب يكمل بعضها بعضاً ولا يغني مذهب عن مذهب، ولأن ولي الأمر إذا أراد أن يقر قانوناً إسلامياً واجب التطبيق، فغالب الظن أنه سيأخذ من أكثر من مذهب؛ حتى يبدو هذا القانون متكاملاً، وبخاصة أنه لا يكاد يوجد مجتهد مطلق أو حتى مجتهد في المذهب. أوردت في الغالب عند الاستدلال للمذاهب: الأدلة من القرآن الكريم، والسنة، والآثار، والإجماع، والمعقول، وأحياناً أذكر أسماء السلف من الصحابة - رضي الله عنهم - ومن بعدهم القائلين بما يتفق مع كل مذهب. بينت الراجح من المذاهب الفقهية بعد عرضها ومناقشتها. دمجت - مختصِراً - رأي المذاهب في كل مسألة، ثم بينت الجانب الذي يظهر فيه دور القاضي وسلطته التقديرية، وأحياناً أُفرد -باختصار- رأي كل مذهب على حدة؛ لإيراد عبارات كل مذهب، ولتعذر الجمع بين رأي المذاهب أحياناً؛ إذ تخص بعض المذاهب جزئيات من المسائل ببعض الشروط التي تجعلها قيوداً عليها، وبعد عرض المذاهب أذكر ملخَّصاً أبين فيه ما اتفقوا عليه وما اختلفوا فيه على وجه العموم. أفدت من الكتب القانونية في طريقة عرض المسائل وتنظيمها، ولم أشر إلى جميعها في الهوامش لأن إفادتي منها كانت على سبيل الإجمال والعموم، وسأورد أسماءها في آخر البحث. خرجت الأحاديث والآثار من الكتب الستة، وكثيراً ما خرجتها من غيرها، وإذا لم يرد الحديث أو الأثر في أحد الصحيحين أورد قولاً أو أكثر لبعض العلماء في درجته. ترجمت للأعلام الواردة في متن صفحات البحث عند ورودها لأول مرة. رقمت المسائل ترقيماً تفريعياً لأهميته الكبيرة في تنظيم المسائل وترتيبها، حيث يسهل ضبط المسائل فيما بينها، وضبط كل مسألة بجزئياتها، ويسهل العزو إلى المسائل السابقة أو اللاحقة، ويظهر بعض المباحث على شكل قانون مقنن. كتبت عناوين الفقرات وأسماء المذاهب بخط غامق في أوائل الفقرات لتسهيل معرفة موضوع الفقرات. جعلت في آخر البحث ملحقاً يتضمن ملخصاً عن البحث وأهم النتائج والترجيحات. أيضاً جعلت في آخر البحث فهارس للآيات الكريمة والأحاديث الشريفة والآثار والأعلام والمراجع والمصادر والموضوعات. -
